Legal framework for using the knowledge and information platform sikwik.com
These Terms of Use govern the relationship between the operator of the platform sikwik.com (hereinafter referred to as "Provider") and the users of the platform. The platform provides editorially prepared content on the topics of digital learning, education, knowledge, and creative discoveries. Use of the content is permitted only for private and non-commercial purposes.
By using the platform for the first time, the user agrees to these terms. If the user does not agree with individual provisions, they are requested not to use the platform.
The user undertakes not to misuse the platform. In particular, it is prohibited to:
The user is responsible for the security of their access data, provided a password-protected area is set up. The Provider is not liable for damages resulting from unauthorized use of the account.
The Provider assumes no guarantee for the completeness, accuracy, or timeliness of the provided content. The content serves exclusively for general information and does not replace professional advice on pedagogical, legal, or medical issues.
The Provider's liability is limited to intent and gross negligence. Liability for slight negligence only applies if a material contractual obligation (cardinal obligation) has been violated. Liability for damages resulting from injury to life, body, or health remains unaffected.
All content published on the platform – in particular texts, graphics, logos, and videos – is protected by copyright. Use of the content is only permitted within the legal limitations of copyright law.
Any use beyond this, particularly the storage, editing, reproduction, or distribution of content, requires the prior written consent of the Provider. Excluded are contents that are expressly marked as Open Educational Resources (OER) and are under a Creative Commons license.
The Provider reserves the right to change these Terms of Use at any time with effect for the future. Users will be informed of material changes by email or through a clear notice on the platform. If the user does not object to the changed terms within four weeks of receiving the notification, the changed terms are deemed accepted.
The Provider will inform the user in the notification of the objection period and the significance of silence. An objection can be sent by email to info@sikwik.com or by mail to Schranzplatz 24.
The user may discontinue use of the platform at any time without stating reasons. The Provider is entitled to block or terminate access to the platform if the user violates material provisions of these Terms of Use.
In the event of a block, existing user data will be deleted, provided no statutory retention obligations conflict. The Provider will, if possible, warn the user before blocking, unless the block is necessary to avert an immediate danger.
Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid regulation shall apply that comes closest to the economic purpose of the invalid provision.
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of performance and jurisdiction is, to the extent legally permissible, the registered office of the Provider. For consumers, the statutory jurisdiction applies.
